The complaints against France Telecom were brought by Liberty Surf and T-Online because France Telecom was abusing its dominant position in the DSL market, favoring its wholly-owned subsidiary, Wanadoo, to the detriment of other Internet service providers.
The French competition authority initially imposed a penalty of 60 million EUR (40 million EUR fine, plus 20 million for repeated infractions), but because France Telecom is not contesting the amount and has refrained from anti-competitive acts, it got a 25% reduction in the penalty (based on the law of 15 May 2001), hence it will have to pay 45 million EUR.
